1. Parties and Subject

The agreement is made between CashCom Systems Limited (reg. No. 75966875, registration date - "29" November 2023, Hong Kong; hereinafter referred to as "Company," "we," "us") and the buyer ("You") regarding the supply of a digital product - eSIM profile/communication plan from partner operators. Physical delivery is not provided.

2. Purchase Methods

  • Without registration: you provide an e-mail for eSIM delivery.
  • With registration: you create an account; access and order history are available in the personal account. You are responsible for the security of your account credentials.

3. Order Process

You select a plan, confirm the parameters, and pay through the payment provider. After payment confirmation, an e-mail with a QR code/activation parameters and instructions is sent. If you have an account, the materials are also available in the personal account.

4. Moment of Conclusion

The agreement is considered concluded after payment confirmation by our payment provider and sending the order confirmation to your e-mail.

5. Electronic Delivery and Timelines

Delivery is made electronically (e-mail/personal account) within a reasonable time after payment (usually within minutes). Delays may occur due to anti-fraud checks/network load.

6. Activation and Start of Term

Unless otherwise specified in the plan description, the validity period begins from the moment of the first activation of the eSIM/connection to the network in the destination country or according to the operator's rules. A delayed start is indicated in the plan card and in the delivery email.

7. Device Compatibility

Before purchasing, ensure that the device: (i) supports eSIM; (ii) is not locked to an operator; (iii) is compatible with the plan/frequencies. We publish a list of compatible devices and recommendations, but the final check is your responsibility.

8. Coverage, Speed, and Limitations

Coverage/speed depend on operators, location, network load, and plan rules (including FUP/throttling). Specific speed metrics and continuity of connection are not guaranteed.

9. Voice/SMS/Emergency Services

Unless explicitly stated otherwise, data-only plans do not support voice/SMS/USSD/emergency service calls. For emergency calls, use a local SIM or alternative means of communication.

10. Regulatory Requirements (KYC)

In some countries, activation of the eSIM may require identification/registration (KYC). You agree to comply with local requirements and provide data to the relevant operator if required.

11. Price, Currency, Taxes

Prices are displayed on the website and may be shown in different currencies. The final amount, including taxes/fees (if applicable), is confirmed at the payment stage. Your bank/provider may charge conversion fees.

12. Payment, Security, and Anti-Fraud

Payments are accepted through payment providers. We may cancel/suspend an order if fraud/legal violation is suspected and request additional verification.

13. Chargebacks

Unjustified chargebacks are considered a violation of the terms. We have the right to provide the payment system with evidence of fulfillment and recover incurred costs within the limits permitted by law.

14. Service Denial and Cancellation

Before the eSIM is delivered, we may refuse service/cancel the order in case of violation of terms or inability to fulfill - with a refund of the paid amounts in accordance with the Refund Policy (/legal/refunds).

15. Assignment

Rights under the order may not be transferred without our consent. Transferring the QR code to third parties is at your own risk.

16. Limitation of Liability

We are not responsible for disruptions in operator/internet provider networks, device incompatibility, and other factors beyond our control. Nothing limits liability that cannot be excluded by law. In other respects, our aggregate liability is limited to the amount paid for the relevant order.

17. Governing Law and Disputes

Law of Hong Kong. Disputes - in the courts of Hong Kong. We are open to pre-trial settlement and/or mediation by mutual agreement.

18. Changes

We may update the Terms of Sale. The current version is published at /legal/sale-terms.
